General

Welcome to the website for the Canucks Autism Network Society (“we”, “us”, “our”, “CAN”).  This document (the “Agreement”) sets out the following rules, terms and conditions (the “Terms”) that apply to your use of all or any of the materials, content and services provided by us through our website located at canucksautism.ca or such other website that we may offer from time to time (collectively, the “Site”).

By using this Site, you (“you” and, together with all persons accessing or using the Site, collectively, the “users”) agree to be legally bound by and abide by the terms of this Agreement. Please read this Agreement carefully as it contains important information regarding your legal rights, remedies and obligations. If you do not agree to be bound by any of the following Terms, please do not use our Site.

Amendments

We may make amendments at any time to the Site, the Terms, and the information contained herein, without prior notice. It is your responsibility to check periodically for changes, and your continued use of this Site will be deemed acceptance of those changes.

Use of Site

You agree to use the Site for lawful purposes only. You shall not use the Site in any way that would interfere with its operation, including but not limited to interfering with or disrupting the Site, or utilizing the Site in any way except as expressly permitted by this Agreement.

Copyright and Trademark Notices

All materials displayed or otherwise accessible through the Site, including without limitation, text, logos, graphics, photographs, images, and illustrations (collectively, the "Content") are protected under applicable Canadian and foreign copyright, and other proprietary and intellectual property laws or other laws. No portion of this Content may be reproduced, other than for personal use, in any form, or by any means, without our express written permission, or in the case of Content provided by another entity, express written permission from the relevant Content provider.

Certain words, phrases, names, designs or logos used on the Site may constitute trademarks, service marks or trade names of CAN or other entities. The display of any such names or marks on the Site does not imply the grant of any license or authorization to any other party. You shall not use any name or mark displayed on this Site without the express written permission of CAN or of the relevant owner of the name or mark.

Third Party Websites and Services

This Site may contain links to other websites (“Third Party Sites”) as well as content and services belonging to or originating from parties other than us (“Third Party Services”). Except where such Third Party Sites and Third Party Services expressly link to these Terms of Use, such Third Party Sites and Third Party Services are not investigated, monitored or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third Party Sites accessed through the Site or any Third Party Services available, including, without limitation, the content, accuracy, reliability or policies of or contained in the Third Party Sites or the Third Party Services.

Should you leave this Site via a link contained herein, and view content that is not provided by us, you do so at your own risk. The inclusion of, or linking to, any Third Party Site or Third Party Service does not imply approval or endorsement by us.

Privacy

We care about the privacy of our users. You can view our privacy policy at http://canucksautismregistration.ca/help/privacy. This Agreement, and our Privacy Policy, together represent the entire understanding between you and us regarding your use of this Site.

Accounts, Passwords and Security

Certain features offered on or through this Site, may require you to register for a user account (“account”) by providing an email address, password, and other information as required. You represent that all information provided by you is accurate, current and complete and you agree that you will maintain and update your information to keep it accurate, current and complete. You agree not to impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or any other personal information about you or about another individual if you are their parent or guardian, in your account or otherwise. You acknowledge that if any information provided by you is untrue, inaccurate, not current or incomplete, we reserve the right to terminate your account.

You must not register for an account on behalf of an individual other than yourself (except if you are the parent or legal guardian to such individual), or register for an account on behalf of any group or non-individual entity (except if you are duly authorized to do so by such group or entity).

You are entirely responsible for maintaining the confidentiality of the information you hold for your account and for all uses of your account, whether or not authorized by you, and any associated charges. You agree to immediately notify CAN of any unauthorized use of your account.

Program Registration Policy

Our programs and events (“Programs”) are intended for individuals and their families living with Autism Spectrum Disorder. All Program participants (“Participants”) must first be registered through the CAN Membership Program at http://canucksautismregistration.ca/account/create, and meet all specified Program requirements (outlined in the Program criteria). We reserve the right to refuse registration if the Participant does not meet the required criteria.

(a)                Refunds

We do not offer refunds. Under extenuating circumstances, the choice to refund, in whole or in part, is solely at our discretion. In the event of a discrepancy or error with your online transaction, please contact info@canucksautism.ca.

(b)               Photographs

Submission of a photograph may be required for Program registration. A submitted photograph must only contain the image of the prospective Participant, and must be reasonably up to date. By uploading a photograph, you represent, warrant and agree that it does not contain unlawful or inappropriate content, and that you have the right to send us the picture.

(c)                Cancellation

We reserve the right to cancel Programs, such as due to inclement weather, facility cancellation, low enrolment, if we cannot provide a safe environment, or other events beyond our reasonable control (the status of Programs will be confirmed on this Site or through communications).

            (d)       Prior Notification

Program attendance is important to us. We reserve the right, in our sole discretion, to refuse future registration for all confirmed Participants who are absent from a Program without prior notification, or who cancel less than 7 days before a Program start date.

Minors

Persons under the age of 19 (“children”) must have a parent or guardian register for an account and for Programs on their behalf.

Disclaimers, Limitation of Liabilities and Indemnities

You acknowledge and agree that all use of this Site is at your own risk. We do not make any representation or warranty of any kind, express or implied: (i) as to the operation of the Site, or the availability of Programs; (ii) that the Site will be uninterrupted or that the Programs or their descriptions will be error-free (including, but not limited to, mistakes or omissions); (iii) as to the accuracy, completeness, reliability, usefulness or currency of any Programs; (iv) or that the Site, its servers, or emails sent from or on behalf of CAN are free of viruses or other harmful components.

CAN and our service providers shall have no liability, whether direct, indirect, consequential, special or incidental, related to or arising from this Site (or any other websites that are linked to this Site) or the use thereof.

You agree to hold harmless CAN and our directors, officers, employees, volunteers, agents and representatives, and all of our service providers, from any and all liability, loss, injury, damages, costs and expenses (including legal fees and expenses) arising from your use of this Site, and reliance by you or any other person on access to this Site, or any information on websites linked from this Site.

Governing Law

This Agreement will be governed by and construed in accordance with the laws of the Province of British Columbia, without reference to its conflict of laws principles.

Waiver and Severability

Our failure to insist upon or enforce strict performance of any provision of these Terms will not be construed as a waiver of any provision or right. If any provision of this Agreement is determined to be invalid or unenforceable in whole or in part, it will be deemed struck and the remaining part of such provision and all other provisions hereof will continue in full force and effect.
